What EU Directive 2023/970 requires — and why size does not change your obligations

EU Directive 2023/970 came into force on 7 June 2026. Every employer in the European Union must now publish salary ranges in job adverts, remove pay secrecy clauses from contracts, and provide employees with documented pay criteria. These obligations apply from day one — to every company, regardless of headcount, and regardless of whether your member state has finished transposing the Directive into national law.

The reporting deadlines are phased. The obligations that carry legal risk today are not.

The 5% trigger — the scenario every employer must avoid

If the gender pay gap within any group of employees doing work of equal value exceeds 5% and cannot be justified with documented, objective evidence, a Joint Pay Assessment becomes mandatory. That is a formal, published process involving employee representatives and the national equality body — with uncapped back-pay liability and the burden of proof shifted entirely to the employer.
